New Housing Code Rules for Tenants and Landlords in the Brussels Region
Starting November 1st, 2024, the Directorate of Regional Housing Inspection (DGHI) will expand its oversight to include all housing, whether rented or not. Tenants filing complaints with DGHI or the Joint Rent Commission will have added protections throughout the process. Landlords can also request a DGHI inspection to ensure their property meets quality standards. Read more about the key changes below.
Key Changes:
Rental Deposit: Limited to two months’ rent (excluding charges) and must not be paid in cash. Landlords have two months post-departure to refund it.
Short-Term Leases: Leases up to three years must disclose the last rental rate, with rent increases only allowed if switching to a long-term lease. Leases can only be renewed once.
New Protections: Standard lease termination forms, clear cost-sharing rules, mandatory fire and water damage insurance for tenants, and invalidated clauses banning pets or domicile registration.
